Government of India in exercise of powers conferred under Section 26-A of the Drugs and Cosmetics Act 1940, vide Gazette Notification GSR 910(E) dated 12/11/2010 has prohibited the manufacture for sale and distribution of the drug ROSIGLITAZONE and its formulation for human use with immediate effect in the country.
Hence all the manufacturers located in this State as well as all the drug distributors, wholesalers and the Medical Stores/Chemist & Druggist in the state are hereby directed to stop the further manufacture for sale as well as sale and distribution of the said drug in the state with immediate effect. All the drugs wholesalers are also directed to re-call all the supplies of the said drug distributed to the retailers from the market and return the un-used stocks to the manufactures under intimation to this Directorate.
All the Doctors, Hospitals, Nursery Homes, etch may please take a note of the above banned drugs and return the stocks.
The Hon'ble Judicial Magistrate First Class, Ponda - Goa, Ms Pooja C
Kavlekar convicted Shri Pandari P Nalk of Kavle, Ponda, for stocking and distribution
of Gutkha under Section 87A Read with Section 87F of Goa Public Health (Amendment)
Act, 2005 to undergo simple Imprisonment of 6 months and to pay fine of Rs 10,000/-
and in default of payment of fine, to undergo Imprisonment of 7 days. The said Judicial
order was pronounced in open court on 20/11/2010.
The case of prosecution was that the Accused Shri Pandari Nalk of Betalwada
Kavlem Ponda was found stocking and distributing Gutkha which food article contains
tobacco and which is injurious in terms of Section 87A of Goa Public Health
(Amendment) Act. 2005 The prosecution case was filed by Food Inspector Shri Rajiv
Korde and assisted by Ld. Asst. Public Prosecutor Mr. C Rodrigues and is one of the
first case that has been convicted by the court with several others to follow.

The Assistant Session Judge, Fast Track Court, Mapusa has Vide order dated
29/11/2010 upheld the conviction order of Mapusa based quack shri Hemantrai Biradar,
which was passed by the Judicial Magistrate first Class, Mapusa-Goa; under Drugs and
Cosmetics Act on 21/04/2010.
Mrs. Jyoti Sardesai, alongwith Medha Dessai the officers of Directorate of food
and Drugs Administration had raided the premises of Shri Hemantrai Biradar. at Mapusa
who was found practicing in allopathy system of medicine without having the requisite
qualification to be considered as Registered Medical Practitioner under Drugs and
Cosmetics Act; and had stocked Drugs; without obtaining licence in contravention of
section 18 ( c) of the Drugs and Cosmetics Act.
A prosecution case was filed against shri Hemantrai Biradar for the above
contravention at JMFC, Mapusa Goa . Sho Vincent D'Silva,Judicail Magistrate First Class had sanctioned the accused to undergo one day simple imprisonment till the rising of the court and to pay a fine of Rs. 5000/-, in default to undergo a simple imprisonment for three months.
Shri Birandar has appealed to the first Tract Court, Mapusa against the above order; which is upheld by Asst. Sessions judge. Shri Narayan S. Amonkar, and the appeal is dismissed.
Asst. Public Prosecutor, Ms Clarita Simons Appeared on behalf of the State at Judicial magistrate First Class Court, Mapusa and Public Prosecutor Mrs. Sunita Nagvekar appeared the First Track Court, Mapusa.
The officials of the Food & Drugs Administration on 5th January 2011 afternoon raided the bungalow of Sudhakar Matkar at Bethoda-Ponda-Goa and seized Gutkha worth Rs. 10.93 Lacks under the provisions of Goa Public (Amendment) Act, 2005.
Shri. Sudhakar Matkar is one of the main suppliers/distributors involved in the trade Gutka and has been booked in the part by this Directorate for a similar offence under the said Act in the past, which case trial is in progress.
The Food Inspector Shri. Abel Rodrigues and Smt. Shradha Khutkar conducted this raid and seizure operation and have now booked another case against Shri. Sudhakar Matkar under the Goa Public (Amendment) Act, 2005
